Summary: We will not investigate this complaint about the Council’s refusal to refund Mrs Z’s estate the overpayments she made to her care home. This is because the Council has agreed to resolve the complaint early by providing a proportionate remedy for the injustice caused.

Summary: We will not investigate Mr X’s complaint about the Council’s response to a health and safety report. This is because there is no evidence the Council’s actions caused Mr X an injustice and, in any event, there is not enough evidence of fault.

This caused Mx X frustration and uncertainty and meant Y missed out on education provision. The Council has agreed to apologise and make payments to Mx X and Y.

Summary: We will not investigate Miss B’s complaint that her car was damaged after hitting a pothole. This is because it is reasonable for Miss B to pursue her compensation claim at court.

Summary: We will not investigate Mrs B’s complaint about the Council’s refusal to remove a tree next to her home. This is because it is reasonable for Mrs B to put in a claim on the Council’s insurance, and if needed, pursue this matter at court.

Summary: Mr X complains that the Council is repeatedly bypassing his bids on properties and that its housing allocations scheme is discriminatory. The Council is at fault as its decision that Mr X is eligible for two and three-bedroom properties disadvantaged him. The Council also wrongly advertised and nominated Mr X for a property he was not eligible for which caused distress to him. The Council has agreed to remedy Mr X’s injustice by making a payment of £200 to him.

Summary: We will not investigate Mr X’s complaint about a building control matter. This is because it is unlikely we could achieve any worthwhile outcome for Mr X. The courts are better placed to decide if Mr X is entitled to compensation and who, if anyone, is liable for his family’s health issues.

Summary: Mr X complained the Council has paid Mrs X a direct payment rate lower than it would have paid a council contracted care provider for her care. I have ended my investigation because

Mr X has started private court proceedings and the court can examine the issues he is unhappy about. Summary: We will not investigate Mr B’s complaint about the Council’s refusal to provide his mother-in-law Mrs C with care and support. This is because it is unlikely we would find enough evidence of fault with the Council’s actions to warrant an ombudsman investigation.
