Summary: We will not investigate this complaint about the Council’s decision to evict Miss X from temporary accommodation. Miss X could reasonably have used her right to go to court.

Summary: Mr A complained about the way the Council has dealt with the introduction of a fee for brokerage and administration of care. He said the Council did not provide enough information to allow him to understand this change. We did not find the Council at fault.

Summary: We will not investigate Mr X’s complaint about the Council’s decision to refuse his application for a vehicle crossover. This is because there is insufficient evidence of fault by the Council to warrant an investigation.

Summary: We will not investigate Mr X’s concerns about the accuracy of information the Council provided to be used for a court report. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. It is reasonable to expect Mr X to raise his concerns at court.

The complainant, Mr X, complains about a penalty charge notice (PCN) issued by the Council. He disputes the PCN and wants the Council to refund his payment for it and pay him compensation.

Summary: We will not investigate this complaint about the Council’s decision not to pay interest on a council tax refund paid to Mr and Mrs X. This is because the tests in our Assessment Code are not met.

Summary: We will not investigate this complaint about the Council’s Education, Health and Care needs assessment process. Any injustice suffered is not significant enough to justify our involvement.

Summary: Ms X complained about the way the Council dealt with her when she was homeless. The organisation delivering the Council’s homelessness service failed to notify Ms X that the Council no longer owed her the prevention or relief housing duties and delayed deciding if the Council owed her the main housing duty. This was fault. This caused Ms X avoidable frustration, for which the Council will apologise. It will also work with the organisation acting on its behalf to ensure it sends notification letters in future and to reduce delays in main housing duty decisions in all instances.

Summary: We will not investigate Mrs X’s complaint about the Council not sourcing suitable carers for her when she needed help with showering. She says the carers did not hold enhanced disclosure and barring service clearance. This is because the complaint is late and there are no good reasons to exercise discretion to consider the late complaint. In addition, there is insufficient evidence of fault.

Summary: We will not investigate this complaint about the Council’s handling of a councillor conduct complaint as it does not cause the complainant a level of injustice that would warrant our further involvement.

Summary: We will not investigate this complaint about the Council providing temporary accommodation which was allegedly unsuitable. This is because the evidence suggests the Council had no notice of any issues from the complainant at the time and therefore could not reasonably investigate. There is insufficient evidence the accommodation was unsuitable.

Summary: We will not investigate this complaint about the Council placing Miss X in temporary accommodation which she says is unsuitable. It was reasonable for her to ask for a statutory review of the decision and she had a further right of appeal to the courts once this was decided.

Summary: We will not investigate this complaint about the contents of a Section 7 report because it concerns matters that either were or could have been discussed in court. Other bodies are better placed to consider other elements of this complaint.

Summary: We found fault on Ms M’s complaint about the Council’s actions when her niece came to stay with her following police involvement which caused her upset and financial loss. It failed to explain to her this was a private family arrangement and what this meant. The agreed action remedies the injustice caused.

Summary: Miss X complains about matters affecting her late aunt, Miss Y’s, discharge from hospital. We will not investigate this complaint. An investigation is unlikely to find fault in the discharge process or achieve the outcomes Miss X seeks.

Summary: We will not investigate Mrs X’s complaint about the Council’s decision to refuse her home to school transport application for her child, Y. This is because there is insufficient evidence of fault.

Summary: Mrs Y complained on behalf of her mother, Mrs X. Mrs Y complained about how the Council dealt with Mrs X’s residential care charges and the Council’s poor communication with Mrs Y about the matter. There were some faults by the Council which caused injustice to Mrs Y. The Council will take action to remedy the injustice caused.

Summary: We will not investigate this complaint about the Council’s failure to take sufficient action over a private home which is in a poor state of repair. There is insufficient evidence of fault which would warrant an investigation.

Summary: We will not investigate this complaint about Business rates liability as this is a matter for the courts.

Summary: We will not investigate Mr B’s complaint that he suffered injuries after slipping on loose grit which the Council left on the pavement outside his home. This is because it is reasonable for Mr B to put in a compensation claim to the Council, and if needed, pursue this matter at court.

Summary: Miss X complains there were failings in the way the Council carried out an assessment of Miss Y’s eligible care needs and provided her with Direct Payments to pay her carer Mr Z causing distress and financial difficulties. We have found no evidence of fault in the way the Council considered these matters. So, we have completed our investigation.

Summary: Mr X complained about the Council’s policy of collecting rubbish from his home in bin bags rather than wheelie bins. We will not investigate this complaint. The Council has now provided Mr X with wheelie bins, and we have decided to discontinue our investigation as further investigation is unlikely to lead to a different outcome.

Summary: We will not investigate Mr X’s complaint about the Council’s decision to install a bollard outside his property. Further investigation would not lead to a different outcome.
