Summary: Ms X complained the Council carried out inaccurate mental capacity assessments for her daughter, Ms Y and did not respond correctly to safeguarding concerns. Ms X said this left Ms Y open to sexual and financial exploitation, caused her considerable stress and damaged her mental health. We will not investigate Ms X’s complaints about the mental capacity assessments as these have now been brought to the Court of Protection. We do not find fault with how the Council dealt with the safeguarding concerns.

Summary: We will not investigate a complaint about a Council’s delay in completing a needs assessment or continuing healthcare checklist following a hospital discharge. This is because there is insufficient evidence of significant injustice linked to any faults with the process.

Summary: Ms X and others complained about the Council’s failure to take action to prevent dust, noise and vibration nuisances from a major construction site near their homes. We have not found fault with how the Council investigated their complaints and the action it took to address the nuisances.

Summary: The Council was at fault for delaying in finalising Mrs X’s son’s Education, Health and Care Plan and putting in place the provision listed in the plan. This caused injustice as Mrs X’s son missed out on receiving the provision he was entitled to. The Council has agreed to apologise and make a payment to Mrs X for the benefit of her son’s education.
