Summary: We will not investigate this complaint about a Penalty Charge Notice. There is not enough evidence of fault in the Council’s actions to warrant investigation.

Summary: We will not investigate this late complaint about the Council’s decision to issue Mr X a penalty relating to an unlicenced House in Multiple Occupation. There is not a good reason for the delay in bringing the matter to us, and Mr X also likely had a right of appeal to the First-Tier Tribunal (Property Chamber – Residential Property), which would have been reasonable for him to use.

Summary: Mr X complained the Council has failed to properly investigate or take appropriate enforcement action in relation to his reports of nuisance in the form of noise, heat and odours from a dry cleaning business operating in the building below his home. We found the delay in investigating Mr X’s concerns about heat affecting his property and the failings in communication are fault. These fault have caused Mr X distress and inconvenience and put him to unnecessary time and trouble. The Council has agreed to apologise and make a payment to Mr X.

Summary: We will not investigate this complaint about enforcement agents clamping a vehicle the person says was displaying a Blue Badge. Further investigation would not lead to a different outcome as there is nothing more we could achieve.

Summary: We will not investigate this complaint about a housing application. The complaint is late without good enough reason to investigate it now. It is unlikely any investigation would find fault in the Council not offering social housing up to December 2022. It is also unlikely we could reach a clear enough view now about a conversation around four years ago. Any complaint about matters after November 2022 should go through the Council’s complaint procedure first.

Summary: We will not investigate this complaint about the operation of private bike hire schemes. This is because there is insufficient evidence of fault by the Council and because there are other bodies who are better placed to consider the issues.

Summary: We will not investigate this complaint about the Council’s decision that Mr X was non-priority homeless in 2023. It was reasonable for him to challenge the decision by way of a statutory review.

Summary: The Council failed to carry out a mental capacity assessment for Ms C at the time it should have. The Council’s contracted care agency, Sage Care, also failed to provide the arranged care to Ms C for two days after she was discharged from hospital. The Council was at fault for not carrying out a mental capacity assessment for Ms C sooner than it did, and for the missed care visits to Ms C. Because of the fault, Ms C suffered a lack of care, and it caused stress to her son, Mr D. The Council will apologise to Ms C and Mr D, make a symbolic payment, and issue staff briefings.

Summary: We will not investigate Miss X’s complaint about the Council’s actions when her son’s Education, Health and Care Plan was transferred to it from another Council’s area. This is because we are unlikely to find fault and any injustice is not significant enough to warrant an investigation at this stage.

Summary: Mr X complains about the way the Council dealt with his homelessness application causing distress. We found fault because the Council wrongly referred him to other councils and delayed accepting a relief duty towards him. We have recommended a suitable remedy in this case so have completed our investigation.

Summary: We will not investigate Mrs B’s complaint about the Council’s decision on her housing benefit entitlement. This is because it is reasonable for Mrs B to put in an appeal to the tribunal.

Summary: We will not investigate this complaint about the Council’s decision on Mr X’s homeless application. It was reasonable for him to ask for a statutory review of the decision.

Summary: We cannot by law investigate this complaint about legal action brought against the complainant by the Council in relation to alleged anti-social behaviour. This is because the issues complained about relate to matters subject to legal proceedings in court.
