Summary: We will not investigate this complaint about the support the Council provided to Mr Y before he died. That is because we do not consider Mr X a suitable representative.

Summary: We will not investigate this complaint about the Council’s decision not to fund respite care for Mr X. That is because there is insufficient evidence of fault to warrant further investigation.

Summary: Mrs X complained the Council failed to provide her daughter with alternative educational provision while she was out of school and delayed the Education, Health and Care plan procedure. The Council accepts it failed to provide educational provision and offered an apology and a payment toward childcare costs. We find the Council acted with fault and the remedy offered did not reflect the injustice caused. The Council has agreed to our further recommendations to reflect the injustice caused by fault.

Summary: We will not investigate this complaint about the permanent exclusion from school of Miss X’s child. We cannot investigate the actions of a school. Miss X was offered a right of appeal to an independent review panel organised by the Council. There is not enough evidence of fault by the Council to warrant investigation.

Summary: We cannot investigate this complaint about the Council’s actions concerning Ms X’s child. The matters complained of are not separable from decisions about where the child should live that have been taken by a court.

Summary: Mrs T complains about how the Council dealt with her application for home to school transport for her child. The Council failed to properly apply the relevant law when it originally refused to award Mrs T’s child school travel assistance. It also refused to backdate and reimburse the travel costs incurred by Mrs T from the date it made its initial error. This has caused Mrs T distress, frustration and time and trouble and financial loss. The Council will take action to remedy the injustice caused.

Summary: We will not investigate this complaint about the care and support Mrs D received from her Care Provider.

Summary: We uphold Mrs X’s complaint, as the Council delayed considering a complaint at stage two of the children’s statutory complaints procedure. The Council has agreed to complete its stage two without further delay and make a payment for the delay so far.

Summary: We will not investigate Mr X’s complaint about the surface of the road outside his property. This is because it would be reasonable for him to serve notice on the Council and take the matter to court.

Summary: Mrs X complains the Council has not dealt with her daughter Miss Y's education properly. The Council is at fault because it did not make alternative education provision, did not consider Miss Y’s special educational needs properly and did not follow its complaints procedure. Mrs X suffered distress and Miss Y missed educational provision and special educational needs provision. The Council should apologise and pay Mrs X £500 for distress and £1200 in respect of missed provision.

Summary: Mrs B complained that the Council acted inappropriately by telling her former foster children’s birth family that it was concerned she may attend their mother’s funeral despite there being no grounds to reach this conclusion. The Ombudsman found no grounds to criticise the Council.
