Summary: We cannot investigate this complaint about the Council failing to risk-assess contact between Mr X’s sons and their birth parents and take appropriate safeguarding action. There has been court action concerning both sons and the matters complained of are not separable from matters that either were or could have been raised in court.

Summary: We will not investigate this complaint about about how the Council dealt with safeguarding concerns raised about a child’s care. This is because court proceedings have commenced to consider the child’s care, and the complaint is not separable from matters which are subject to these proceedings.

Summary: Ms Z complained on behalf of Mr Y and his mother, Ms X, that the Council: took too long to review Mr Y’s Education, Health and Care (EHC) plan, despite being aware he was not in education, failed to secure any of the provision in the EHC plan and failed to issue an amended plan or other decision which delayed their appeal rights; failed to act in line with Care Act duties. As a result, Mr Y missed out on education and social care support and the Council’s proposed remedy did not reflect the injustice to them.

Summary: We will not investigate Mr X’s complaint that the Council charged him an empty property council tax premium and refused to reduce it. We cannot lawfully question the Council’s council tax exemption policy or achieve the outcome Mr X wants.

Summary: We will not investigate Mr X’s complaint that the Independent Review Panel held following his son’s exclusion from school was procedurally flawed. That is because the Council was acting on behalf of an academy school and we have no jurisdiction to consider complaints about academies.

There was no fault in how the Council carried out its safeguarding investigation.
