However, the Council was at fault because it did not maintain an adequate level of contact with the complainant, which caused him frustration. The Council has agreed to formally apologise and offer a small financial remedy to reflect this.

To remedy this injustice, the Council has agreed to apologise, make a symbolic payment and review its procedures.

Summary: Mr X complained that he was unable to challenge a Fixed Penalty Notice because of fault on the part of an Enforcement Agency contracted by the Council. We found no fault by the Enforcement Agency or the Council. Another agency is better placed to deal with Mr X’s complaints about data retention and deletion.

Summary: Mrs X complained about the Councils handling of her Disabled Facilities Grant application. She also complained about poor communication. Mrs X said this distressed her family. There was fault in the way the Council delayed approving the application and miscommunication. This fault distressed and frustrated Mrs X. The Council should apologise, make a financial payment and remind staff about its duties.

Summary: Mrs Y said that development caused her land to flood and complained about the Council’s planning enforcement investigations into the development and its use of an unenforceable planning condition. We found no fault in how the Council dealt with Mrs Y’s complaints.

Summary: We will not investigate this complaint about the refuse crew throwing rubbish into the complainant’s garden. This is because there is insufficient evidence of injustice.

Summary: We will not investigate this complaint the Council did not instruct the Parish Council to hold an election. There is not enough evidence of fault to justify our involvement. Any complaints Ms X has about how the Council responded to her Freedom of Information request are for the Information Commissioner’s Office.
