It is reasonable for Ms X to complain to the Information Commissioner’s Office as it is better placed.

Summary: We will not investigate this complaint about damage caused to Mr X’s property by refuse collection crews. He has made an insurance claim against the Council for his losses. Where no liability is accepted it is reasonable to challenge the claim in the courts. The Council has apologised for bad language by refuse staff which Mr X reported.

Summary: We will not investigate this complaint about how the Council considered a planning application. Planning permission has not yet been granted; therefore, we cannot yet say the complainant has suffered a significant personal injustice.

Summary: We will not investigate this complaint about Mr X’s council tax liability. Mr X used his right of appeal to the Valuation Tribunal, and we have no power to investigate the matter or consider Mr X’s reasons for appealing late.

Summary: Mr D complains the Council has not cut back trees overhanging his home. The Council accepts it is at fault and will carry out a new survey of the trees. The Ombudsman has completed the investigation and upheld the complaint.

Summary: We will not investigate this complaint about the Council’s investigation of a licensed taxi-driver. That is because it does not meet the tests set out in our Assessment Code.

Summary: We will not investigate this complaint about homelessness and housing matters. The law prevents us considering the management of Mr X’s Council tenancy. Other points are late or concern matters where Mr X could reasonably have used his rights to seek a review of the suitability of accommodation and, if necessary, to go to the county court.
