There is insufficient evidence of fault in the care home’s decision to seek assistance from the Urgent Community Response Team.

Summary: We will not investigate Mr B’s complaint that his car was damaged by a road defect which the Council had failed to repair. This is because it is reasonable for Mr B to pursue his compensation claim by taking the Council to court.

Summary: Mr X complained the Council wrongly refused to provide free home-to-school transport for his child, Y, to attend the only school named in Y’s Education, Health and Care (EHC) Plan. The Council was at fault when it said there were closer schools which Y could attend because it had not named these in Y’s EHC Plan. This fault caused Mr X an avoidable financial burden, frustration and avoidable time and trouble. Summary: We will not investigate Mr & Mrs X’s complaint about how the Council dealt with child protection enquiries. This is because doing so would not add to the investigation carried out by the Council, or lead to a different outcome.

Summary: Ms B complained that the Council had unreasonably (and at short notice) removed her daughter’s bus pass for free transport to school from Ms B’s address.The Council did not properly consider the question of where C’s main residence was and has failed to offer an appropriate remedy for the injustice caused to Ms B and C. The Council has now agreed to apologise to Ms B, pay her £1250, consider any new application she submits and improve its procedures for the future.

Summary: We will not investigate this complaint about the Council’s handling of Ms X’s housing register application because there is not enough evidence of fault.

Summary: We will not investigate this complaint about the way the Council dealt with a high hedge complaint, reports of breaches of planning control and data protection breaches. We cannot consider matters relating to the high hedge complaint as Mrs X has appealed to the Planning Inspector. This matter is therefore outside our jurisdiction.
