Conclusion
There has been considerable uncertainty about the scope and function of the review of the implementation of the UK-EU Trade and Cooperation Agreement (TCA) which is required to take place this year. Although the 98 political summit process initiated in May 2025 has, in the Minister’s words, “overtaken” the review, we believe the latter can still play a valuable role as a technical process to help the UK and EU identify how the Agreement is being implemented in practice and where there is untapped potential within its existing provisions to improve trade and cooperation. In that way, the TCA review and the annual summits of the Strategic Partnership are complementary to one another. (Conclusion, Paragraph 183)

At the last meeting of the TCA Partnership Council on 2 February, the UK and the EU agreed that the provisions for the review of the implementation of the TCA under Article 776 had been substantially delivered through the commitments made at the 2025 UK-EU Summit, particularly under the Common Understanding. This assessment was reached jointly, reflecting a shared view that the TCA is broadly functioning as expected and that a resource-intensive, maximalist review process is not warranted. This reflects the Government’s determination to deliver on its manifesto commitments to reset relations with our European partners and not to wait to strengthen our cooperation with the EU under a narrow review of the operation of the TCA. Notwithstanding the action the Government has already taken, we remain committed to engaging with key stakeholders on how the TCA is being implemented, and compliance with TCA provisions continues to be scrutinised via its 19 Specialised Committees. The Government also produces biennial reports on the implementation of the TCA, with the last of these being published in September 2025.
