As no government can bind its successors, all government promotions should clearly state that “the future terms and conditions of your loan can be changed retrospectively by future governments”. The statement provided in some historic materials that “all policies are kept under review” is not sufficiently clear and in our view would amount to a breach of the FCA’s Consumer Duty.
