Recommendation
The government should reconsider whether the bill should be amended to allow for Special Advocates to be appointed to inquisitorial proceedings in exceptional circumstances. In any case, if the courts in due course confirm that the provisions in the Inquiries Act 2005 (on which the equivalent Part 4 provisions were modelled) allow the chair of a public inquiry to appoint a Special Advocate, the Legacy Commission should be given an equivalent power. (Recommendation, Paragraph 59)
