In its response to this report, the government should set out its detailed legal analysis concerning: a. Whether the blanket inadmissibility of ICIR-held evidence in criminal proceedings is compatible with human rights in particular where key exculpatory evidence for a serious crime—like murder—is held by the ICIR and is not available from any other source; and 95 b. What work the government has done to mitigate the risks of such a scenario arising or the impact of such a scenario. (Recommendation, Paragraph 152)
