In order to ensure compatibility with the right of access to a court under Article 6 ECHR, the Secretary of State should also consider setting up an independent process which would allow individuals to seek independent redress in appropriate cases—such as employment cases—without undermining the ‘black box’ approach of the ICIR by submitting the dispute to a national court.
