To preserve the principle of equality of arms, legal aid barristers should be paid comparable rates to state barristers in claims against public authorities. In order to prevent cannibalisation from other civil legal aid fee schemes, non-inquest categories must also have their fees uplifted such that they are competitive with any new rates chosen by the government.
