Public inquiries and courts using the Closed Material Procedure can create documents containing ‘closed’ findings, in addition to the published ‘open’ findings. Such ‘closed’ findings are an integral part of an investigation being effective and thorough in ascertaining the facts surrounding a death. The Legacy Commission’s Part 4 inquisitorial proceedings, which are modelled on public inquiries, should therefore also be able to create ‘closed’ versions of final reports so there can be a full finding of facts and lessons learned, even if those full facts cannot be made public at that time due to national security.
