However, it is not clear that the Legacy Commission will have the power to do so under the bill as currently drafted. There is no principled reason why the Legacy Commission should not be able to produce ‘closed’ findings. Indeed, a lack of ‘closed’ findings giving a full picture of the circumstances surrounding the death in relevant cases could be indicative of a lack of an effective investigation for the purposes of Article 2 ECHR.
