Recommendation

Healthcare employers recruiting nursing staff, whether qualified or unqualified, should assess candidates' values, attitudes and behaviours towards the well-being of patients and their basic care needs, and care providers should be required to do so by commissioning and regulatory requirements.

The following publicly available evidence relates to this recommendation:
- The government's response in "Hard Truths" (Cm 8777, November 2013) accepted this recommendation and committed to ensuring values-based recruitment was adopted across the NHS for both qualified and unqualified staff (Hard Truths: the Journey to Putting Patients First, DHSC, November 2013).
- Health Education England published its National Values Based Recruitment Framework in October 2014, applying to both higher education institutions recruiting student nurses and NHS employers recruiting qualified and unqualified nursing staff. The framework required employers to assess candidates' values, attitudes, and behaviours alongside clinical competence (Values Based Recruitment Framework, HEE, October 2014).
- The Care Certificate, launched 1 April 2015, requires all new healthcare assistants and social care support workers to complete a standardised induction covering 15 standards, providing a baseline assessment of unqualified staff's values and skills (Care Certificate, HEE/Skills for Care/Skills for Health, April 2015).
- CQC's inspection framework, introduced from October 2014, includes assessment of how providers recruit staff with the right values under the "well-led" key question. The government published "Hard Truths: the Journey to Putting Patients First" (Cm 8777) on 19 November 2013, responding to all 290 recommendations of the Francis Report. This followed an initial response "Patients First and Foremost" in March 2013. Key reforms included a new Chief Inspector of Hospitals, strengthened Care Quality Commission inspection regime, a statutory duty of candour, and the fit and proper person test for NHS directors. Academic Review - Ten Years After Francis

Research published 2023 marking ten years since the Francis Report found mixed results. Structural and legislative changes largely delivered (duty of candour, FPPR, CQC overhaul, revalidation, Freedom to Speak Up Guardians). Legislation - Integrated Care Boards (Health and Care Act 2022)

Clinical Commissioning Groups replaced by 42 Integrated Care Boards from 1 July 2022 under Health and Care Act 2022. ICBs have broader responsibilities for population health, bringing together NHS organisations, local authorities and partners. Implements some Francis recommendations on commissioning integration.

NMC - Nursing Revalidation

NMC Revalidation launched 1 April 2016 in direct response to Francis Report. All nurses and midwives must revalidate every three years. Replaced the Post-Registration Education and Practice system. Updated NMC Code published March 2015 strengthened requirements around candour and raising concerns.

NMC published updated Code of Professional Standards for nurses and midwives (March 2015). Standard 14 specifically requires nurses and midwives to be open and candid with all service users about all aspects of care, including when mistakes or harm have occurred.

UK Government - Culture Change in the NHS

Government published "Culture Change in the NHS" (Cm 9009) reporting progress on all 290 recommendations. Key achievements: 19 hospitals placed in special measures; those trusts recruited 109 additional doctors and 1,805 additional nurses; 129 board-level changes made; excess avoidable deaths fell by 450 in less than a year.

Legislation - CQC Fundamental Standards

New "Fundamental Standards" replaced previous CQC registration requirements from 7 November 2014. CQC - New Inspection Regime

CQC overhauled its inspection regime in response to Francis. Professor Sir Mike Richards appointed as first Chief Inspector of Hospitals (July 2013). New methodology based on five key questions (Safe, Effective, Caring, Responsive, Well-led) rolled out nationally October 2014. Four-tier ratings introduced (Outstanding/Good/Requires Improvement/Inadequate). Specialist expert-led inspection teams replaced generalist compliance model.

NICE - Safe Staffing Guidance SG1

NICE published "Safe staffing for nursing in adult inpatient wards in acute hospitals" (SG1) on 15 July 2014. Evidence showed increased risk when registered nurse cares for >8 patients. Red flag: fewer than 2 RNs on any ward during any shift. However, NICE's broader safe staffing programme was controversially halted in June 2015 by NHS England. No mandatory nurse-to-patient ratios introduced in England (unlike Wales).
